Terms and Conditions of BSS GmbH.
§1 Applicability, Definition of Terms
(1) The following Terms and Conditions shall apply for all Deliveries between ourselves and the Customer in their version valid at the time of placing the order.
(2) Customer within the meaning of these Terms and Conditions are both Consumers and Entrepreneurs. A Consumer means any natural person who is acting primarily for purposes which are not related to his or her trade, business or profession, as defined by Section 13 of the German Civil Code (Bürgerliches Gesetzbuch, BGB). An Entrepreneur in the sense of Section 14 of the German Civil Code is any natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.
(3) These Terms and Conditions shall apply in relation to both Consumers and Entrepreneurs, unless otherwise expressly specified in the relevant regulation by the use of the term Consumer or Entrepreneur.
§2 Conclusion of Contract, Storage of the Contractual Text
(1) The following Regulations for the Conclusion of Contract shall apply for all orders via our online shop https://bogensportshop.eu.
(2) Our online shop is directed exclusively to consumers, entrepreneurs and other individuals with residence or domicile in a member state of the European Union (EU) or the European Economic Area (EEA). If there is reasonable assumption of residence or domicile outside the EU or the EEA, the contract shall be deemed invalid and there shall be no delivery obligation.

(4) The presentation of the products in our online shop does not constitute a binding offer by us. It represents a non-binding offer to the Customer to order products. On ordering the selected products, the Customer enters into a binding offer for concluding a purchase contract.
(5) The Customer enters into a binding offer for concluding a purchase contract, by taking the necessary steps for completing the ordering procedure:
1) Selection of the desired products
2) Confirmation by clicking the button „Add to cart“
3) Checking of the details in the shopping cart
4) Confirmation by clicking the button „Proceed to checkout“
5) Login to the online shop after registration and supplying the necessary credentials (email address and password).
6) Renewed checking and if necessary, correction of the supplied data.
7) Binding transmittal of the order by clicking the button “Buy now”
(6) Before the binding transmittal of the order, by using the “Back” button of the internet-browser of the Customer, the Customer is able to return to the cart, where he can correct the order data. At any time before the binding trasnmittal of the order, the Customer is able to abort the ordering procedure by closing the internet-browser.
(7) We confirm the receipt of the order via an automatically sent email immediately (order confirmation). By doing so, we accept your offer.
(8) We store the Contractual Text and we send you the order information and our Terms and Conditions by email. You may access these Terms and Conditions at any given time under https://bogensportshop.eu/en/info/conditions-of-use.html.
§3 Prices, Shipping Costs, Payment, Maturity
(1) The declared prices are final prices includign all taxes plus shipping costs.
(2) The Customer is able to pay via bank transfer or one of the available instant payment methods.
(3) If the Customer chooses payment via Bank Transfer as payment method, the Customer agrees to pay the purchase price immediately after Conclusion of Contract.
§4 Delivery
(1) The delivery time of each variant of each product is displayed on the product page after the variant has been selected via the available drop-down menus. If the product has no variants, the delivery time is displayed immediately when visiting the product page. In the case of Bank Transfer as the payment method, the Term of Delivery shall begin on the day after the payment order was submitted by the Customer at the Customer’s bank. For all other payment methods, the Term of Delivery shall begin on the day after Conclusion of Contract. In the event that the deadline falls on a Saturday, Sunday or public holiday on the place of delivery, the deadline is the next working day.
(2) If the Customer is a Consumer, the risk of accidental loss and accidental deterioration of the products shall be transferred to the Customer upon handover of the product to the Customer. If the Customer is an Entrepreneur, the risk of accidental loss and accidental deterioration of the products shall be transferred to the Customer at the place of performance.
(3) If the goods are offered to the customer as owed at the agreed place and at the agreed time, but the customer refuses to accept the goods, a default of acceptance arises. If we have to process returns due to default of acceptance as a withdrawal, the customer will bear the cost for the shipping costs both ways plus a processing fee of EUR 9.50 plus applicable VAT.
§5 Right of Withdrawal
If the Customer is a Consumer, the Customer is entitled to the right of withdrawal according to the Instructions on withdrawal.
§6 Reservation of Title
We reserve the title to the goods until the purchase price has been paid in full.
§7 Warranty
If the Customer is a Consumer, the statutory warranty regulations shall apply. If the Customer is an Entrepreneur, the period of limitation for claims for defects shall be one year in case of delivery of new items, starting from the transfer or risk. The legal periods for recourse action according to Section 478 of the German Civil Code remain unaffected. The period of limitation for claims for defects shall be one year in case of delivery of used items, irrespective of the status of the customer.
§8 Online Dispute Resolution of the EU Commission
The platform of the EU Commission regarding online dispute resolution can be visited via following URL: http://ec.europa.eu/consumers/odr. We are not obliged to take part in a dispute settlement procedure before a consumer arbitration board and we do not participate in alternative dispute settlements before a consumer arbitration board.
§9 Final provisions
(1) The law of the Federal Republic of Germany shall apply exclusively with the exception of the UN Sales Convention (CISG).
(2) In the case of the Customer being the proprietor of a business, a body corporate under public law or a separate estate under public law, the place of performance and jurisdiction for deliveries and payments and all disputes arising between us and the Customer based on the purchase contracts concluded between us and the Customer shall be our place of business in Aachen, Germany.
